Terms of service
GrailVault — Terms and Conditions
Operated by Dan Alexander Ltd
Last updated: 22 October 2026
1. Introduction and business identity
These Terms and Conditions govern use of https://grailvault.co.uk (the Website) and purchases made through the GrailVault online shop. GrailVault is a trading name of Dan Alexander Ltd, a company registered in England and Wales (the Seller, we, us or our). You means a visitor or customer.
Our Website is operated using Shopify's e-commerce platform. Your contract for the purchase of goods is with Dan Alexander Ltd, not Shopify. These Terms should be read alongside our Privacy Policy, Returns and Refunds Policy and Shipping Policy, available on the Website. Nothing in these Terms restricts rights that cannot lawfully be excluded under UK consumer legislation.
2. Using the Website and customer accounts
You agree to use the Website lawfully and provide accurate, current contact, delivery and payment information when placing an order. If you create a customer account, you are responsible for keeping your sign-in credentials secure and notifying us promptly if you suspect unauthorised access. You must be legally capable of entering into a contract to place an order; if you are under 18, you should obtain the consent and assistance of a parent or guardian.
You must not impersonate another person, attempt to interfere with the Website's security, introduce malicious software, harvest other customers' personal data or use the Website for fraudulent purposes. We may restrict access where reasonably necessary to protect the Website, customers or our legal interests, without affecting existing consumer contracts or statutory rights.
3. Products, descriptions and condition
GrailVault sells collectables and alternative giftware, including Funko Pop! figures, Nemesis Now figurines, gothic and fantasy ornaments, limited editions and other collectable merchandise. Stock may include new, pre-owned, discontinued, vaulted and hard-to-find items.
We take reasonable care to describe products accurately and to show their condition in photographs. Product photographs may vary slightly in appearance owing to lighting, screen settings and the individual item. Where condition grades such as mint, near mint, excellent, very good or good are used, they reflect our reasonable assessment of the particular item; any significant known visible faults should be identified in its listing.
For boxed collectables, the original packaging may be an important part of the item's collectable value. Please read the listing carefully to establish whether the stated condition refers to the figure, the box or both. Any grading or photographs form part of the product description and do not replace your statutory rights. Goods must be as described, of satisfactory quality and fit for purpose where required by the Consumer Rights Act 2015.
4. Limited editions, rarity and collectable values
References to limited editions, numbered runs, exclusives, vaulted status, rarity and availability are made in good faith using information reasonably available to us. A limited edition is not necessarily vaulted, and a vaulted item is not necessarily rare. We do not guarantee that any item will retain or increase its market value.
Certain items may be unique or difficult to replace. If an item cannot be supplied or replaced, we will provide the remedy required by applicable law.
5. Ordering and contract formation
Placing an order constitutes an offer to buy the goods shown in your basket. Shopify may send an automatic order acknowledgement; this confirms receipt of your order but is not, by itself, acceptance of your offer. Our acceptance occurs when we send confirmation that your order has been dispatched, at which point a sales contract is formed.
We may decline an order before acceptance for legitimate reasons, including stock unavailability, an obvious pricing or listing error, suspected fraud or inability to deliver to the address provided. If payment has already been taken for an order we decline, we will refund it in full without undue delay. We will contact you using the details supplied where reasonably practicable.
Nothing in this section removes a customer's statutory rights to cancel an eligible distance contract or obtain remedies for goods that do not conform to the contract.
6. Prices, VAT and payment
Unless otherwise indicated, prices are displayed in pounds sterling (GBP). Prices include VAT where applicable and required by law. Any delivery charges and other compulsory charges will be shown before you complete checkout. Where international orders are offered, additional import duties or taxes will be explained where applicable and reasonably ascertainable.
Payments are handled through Shopify Payments and/or other payment providers offered at checkout. We do not ordinarily receive or store complete payment card numbers. Payment providers may perform security and fraud-prevention checks under their own terms and privacy notices.
We may change prices or promotions prospectively. Changes will not alter the agreed price of an order already accepted.
7. Delivery and risk
Available delivery options, charges and estimated times are set out at checkout or in our Shipping Policy. We will use reasonable care to dispatch and deliver goods within the stated period. Unless another delivery period is agreed, goods must normally be delivered within 30 days of contract formation.
For consumer orders, goods remain at our risk until they come into your physical possession, or that of a person you have identified to receive them, subject to the applicable legal rules where you independently arrange your own carrier. Handing a parcel to our courier does not, by itself, transfer that risk to you.
Please contact us promptly if goods are missing, delayed or arrive damaged; photographs of the packaging and contents can help us investigate. Your rights concerning late delivery, non-delivery and damaged goods are not affected by carrier delays or this request for photographs.
8. Statutory cancellation rights for online purchases
For most eligible consumer purchases made online, you have the right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel without giving a reason within 14 days after the day you, or a person nominated by you, receive the goods. Different rules may apply to split deliveries and legally exempt products.
To cancel, tell us clearly of your decision within the cancellation period, using our contact details below or the cancellation method made available on the Website. You may use a model cancellation form if one is provided, but you do not have to use a particular form. After notifying us, you must normally send the goods back within 14 days.
Provided you were informed before purchase, you are responsible for the direct cost of returning goods following a change-of-mind cancellation, unless we agree otherwise. We will refund the price of the cancelled goods and the basic cost of outbound delivery, where applicable; any extra charge for a premium delivery option need not be refunded.
We will make the refund without undue delay and no later than 14 days after receiving the returned goods or satisfactory evidence that you have sent them back, whichever is earlier. Where goods have not yet been supplied, the applicable refund deadline runs from notification of cancellation. Refunds will ordinarily be made to the original payment method without a refund fee.
9. Returns, packaging and faulty goods
You may handle goods to the extent reasonably necessary to establish their nature, characteristics and functioning, as you could in a shop. If handling exceeds this and reduces their value, we may make a deduction from a cancellation refund only where permitted by law.
For collectables, we strongly recommend keeping boxes, inserts, seals and protective packaging in good condition. Removing or damaging packaging does not automatically extinguish a statutory cancellation right; any permitted deduction depends on the circumstances and applicable law.
If goods are faulty, damaged, not as described or otherwise fail to meet the Consumer Rights Act 2015, you may be entitled to a refund, repair, replacement or price reduction, depending on the circumstances. Rights for faulty or misdescribed goods are separate from change-of-mind cancellation rights, and we will meet return costs where required by law. See our Returns and Refunds Policy for practical instructions.
10. Stock, errors and promotions
Stock levels and availability may change, particularly for one-off and limited-edition items. We may correct obvious typographical errors, incorrect photographs, inaccurate stock information or pricing mistakes. Where an error affects an order already accepted, we will contact you and resolve the matter consistently with the contract and applicable law rather than unilaterally removing your statutory rights.
Any special promotional conditions will be displayed with the relevant offer. We will not apply undisclosed conditions retrospectively to an accepted order.
11. Intellectual property and third-party brands
The original GrailVault branding, text, photographs, graphics and other materials created by or for us belong to Dan Alexander Ltd or the relevant rights holders. You may browse the Website and use its content for ordinary personal shopping purposes. Commercial reproduction or misuse of protected material requires appropriate permission.
Funko Pop!, Nemesis Now and other third-party names, characters, logos and trademarks belong to their respective owners. They are used to identify genuine products offered for sale. Unless explicitly stated, GrailVault is an independent retailer and is not affiliated with, endorsed by or sponsored by those brand owners.
12. Customer reviews and feedback
If you submit a review, photograph or other feedback, you confirm that it is lawful, truthful to the best of your knowledge and that you have the necessary rights to share it. You give us a non-exclusive, royalty-free licence to display and reasonably reproduce that content in connection with operating and promoting GrailVault, subject to applicable privacy, consumer and intellectual property laws.
We may moderate or remove unlawful, misleading, abusive or irrelevant submissions. We will not knowingly misrepresent customer reviews or conceal incentives contrary to applicable law.
13. Third-party links, tools and Shopify
The Website may contain links to third-party websites or offer optional tools provided by other organisations. Those services may have their own terms and privacy policies. We are not responsible for the independent content or operation of unrelated third-party websites, but nothing here excludes liability that we owe you under law in connection with goods or services we supply.
Shopify provides the technology supporting the online shop and may process information needed to deliver its services. Dan Alexander Ltd remains the seller and the party responsible for fulfilling your GrailVault orders and applicable consumer obligations.
14. Privacy and electronic communications
We process personal information in accordance with our Privacy Policy and applicable UK data protection legislation. Shopify and authorised payment, delivery and other service providers may process information as described in that policy and their own notices.
We may send order acknowledgements, dispatch notifications, return updates and other necessary service messages electronically. Marketing messages will be handled in accordance with applicable consent and electronic marketing rules.
15. Website availability and liability
We take reasonable care to keep the Website accurate, secure and available, but temporary interruptions or technical errors may occur. We are not responsible for losses caused solely by circumstances outside our reasonable control where the law permits that limitation.
Nothing in these Terms excludes or restricts liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded. Nothing limits your rights under the Consumer Rights Act 2015 or other applicable consumer legislation. We do not exclude liability for foreseeable loss caused by our breach of a consumer contract where doing so would be unlawful or unfair.
16. Suspension and misuse
We may take proportionate steps to prevent fraudulent, abusive or unlawful use of the Website, including restricting an account where justified. This does not cancel rights already accrued under an accepted order or remove any statutory remedy.
17. Changes to these Terms
We may update these Terms from time to time. The version published when an order is placed will ordinarily apply to that order, unless a lawful variation is expressly agreed. Changes will not retrospectively remove rights under accepted orders. We will give notice of material changes where required by law.
18. Governing law and disputes
These Terms are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply to you. Consumers may bring proceedings in the courts available to them under applicable law; this clause does not remove mandatory rights to use courts in another UK jurisdiction where applicable.
19. Severability and entire agreement
If any part of these Terms is found unlawful or unenforceable, the remaining provisions will continue to apply insofar as legally possible. These Terms, together with the policies and product information expressly incorporated into the contract, set out the relevant agreement for use of the Website and purchases. No provision overrides statutory rights.
